I just got an email from a client that I did an inspection for back in August. The client was inquiring about a mold policy with my inspection. I told them that the policy for MoldSafe is 90 days from the inspection or 22 days after closing (since I didn't remember the actual closing date. I offered mold testing if needed. I got a reply back:

Okay, looks like we are past that. Do you do free estimates? I'll kind of give you a heads up on what is going on. When we purchased the house our Realtor hired an inspector for our septic tank. The Realtor (instead of giving accurate information) told the inspector that the septic tank was 12 years old. Well a month into buying the home we got papers from the health department saying that our septic tank is illegally discharging waste. So we got a hold of our realtor he paid for someone to come out and dig and see what was going on. Well this inspector told us that this septic tank is 70+ years old and it actually isn't functioning and the waste is just sitting in the ground against our wall. The Realtor is of course saying that he isn't held responsible and the estimate for a new septic tank and seepage bed is around $7000, so we are taking legal action. If we can prove that the mold is from this I would like to include that in with the legal matters. I have attached a pictures.
I am not 100% sure if it mold but wanted to check in with you.

My question is how far should I go with this? If I remember correctly, the agent was both the seller & buyer agent. I have received several inspections from this agent and don't want to piss off this agent as I would hate to lose additional referrals.

Other tidbits about the inspection before everyone ask - I did not do the septic inspection. Foundation had some water seeping in as it is an old red brick foundation. The plumbing was turned off at time of inspection so I could not check the supply or waste side.

If you are looking to keep the agent then I would stay out of it. There is probably no way for you to know what is causing the mold.

If there is and you say it's from the tank and the buyer tells the agent that you said that's where the mold is coming from, I want it added to the $7k then don't expect the agent to keep using you.

I would have a mold remediation or restoration company tell them where it's coming from.

Chad you did not tell us where the mold like substance(S) were found. Kinda makes a really important difference.

The picture (which I didn't attach) shows darkened areas of the red brick foundation. By looking at their picture it's hard to guess it is mold like.

It might be mold, or not, but how do you prove it's from the tank leaking? They'd have to dig up and trace liquid flow and test the wall for e-coli. I'd stay out of it and recommend they have the septic people figure it out and provide documentation. You'll probably lose the referrals anyway, slim chance not. Best to not be involved is my call.

The brick might just be dark from absorbing moisture. I agree, nothing to do with mold.

I actually had to politely argue to a buyer this week that I would not put mold on the house exterior in the report. This in front of her husband, her parents and both rea's.

I agree with Mike. You are probably going to lose this agent regardless (or at least temporarily).

You didn't test the septic. It's not your fight. That said, here's my .02 cents

Who gave the realtor the 12 yrs old information? Im guessing its not in writing? any witnesses to that conversation.
Were the home owners ever notified previously about the grey water? This all seems like its on the previous owners from where I sit. You don't have anything in writing anywhere that states you include dye testing for all inspections, I hope?

Great questions. Unfortunately I don't know the answers to any of those. As for the previous owners, if I remember correctly, it came from a couple a women that wanted to flip a house. I was able to see certain improvements, but others were truly lacking. The one thing I remember most about this house was that the foundation was 3.2 inches out of level.
